    Hello I have an adult site that hosting porn in my vps. My vps is an usa one so DMCA issues coming. I have dmca page too. So I need to know if they sent a dmca issue regarding my post ,am I safe after delete it or can they file case about it?

    What should I do?

    Are you really hosting porn videos on your VPS server? It is going to cost you lots of money, because once you get more traffic, you will run out of bandwidth and disk and you will need a big dedicated server.

    If you get the proper DMCA notice, then take the infringing video down and respond back that it has been deleted. You might get yourself into big problems, if you reportedly get such notices from the same company, they might go after you, because you can not just download and upload some content you have found on some adult sites, you need to either buy it or you can embed from other tubes or use the affiliate promotional content.

    If I go with offshore hosting is it good?

    First of all, hosting videos on the VPS is a bad practice since they do not handle streaming content very well. You have to spend at least $200 on a dedicated server that will handle this kind of things and I am running an adult tube myself so I know it first hand but I own lots of content and I also work with pay sites as an affiliate.

    Now, if you want to host pirated videos then no offshore hosting will help you because you will always get the DMCA notices and they will also send a notice to Google so they remove your pages.

    I understand that embedding videos have some disadvantages but you can remove popup ads by using the plugins like the KenPlayer and it does work well as I have read on here and it is very cheap to have a tube that shares others’ videos instead of hosting them.

    If you don’t have a budget for a great dedicated server, then why not try to sign up as an affiliate for programs that are related to your porn sites and work with them. They give promotional content including videos and you can of course also use XVideos, PornHub.

    The DMCA is the USA’s law and of course, if you are hosting in the United States, you will have to obey the law and remove the content. I run a tube myself and offshore hosting isn’t an answer because they will get rid of you as soon as they get threatened with some legal actions (I have read it happen to a few adult webmasters that were streaming full videos and their offshore hosting took their sites offline after receiving letters from lawyers). So, I am not sure what you do and what kind of content you post, but better try to do the things the right way. I share embed videos on my tubes and I never had any problems expect receiving some DMCA notices, but I make sure that videos that add are bluntly copyrighted (read stolen).

    I can only say that stealing videos from big porn pay sites (I am not talking about amateur videos), can sooner or later get you into trouble, no matter where you are hosting. Even PornHub had a few lawsuits filed against them but they are filthy rich and they have settled the case. There are porn tubes like anon-v.com ignore all my DMCA requests but it’s only a matter of time before someone with top lawyers goes after them.

    Just complying with all legit removal notices you receive, should be fine, but if you constantly get them from one adult studio, company, they might get enough and sue you.

    Only a few off shore hosting providers don’t really comply with DMCA complaints but keep in mind that they are expensive and they will reveal your information once the things get serious like getting sued.

    If you go with the embedding route, then don’t recommend using sites like OpenLoad for hosting videos, since they are very risky because they can delete all your files in one click and such sites always disappear, sooner or later, after someone goes after them.

    Even if you host with the offshore server, they can go after your domain name like with the PirateBay and seize it. You need to know that when you deal with big companies that they have well paid and good lawyers that are know how to deal with such situations.

    Why not think long term and go with the more viable business model like affiliate marketing or even video embedding with the well known tubes not some pirating sites like others have already suggested.

    To be honest, I don’t know a hosting, even an offshore one, that won’t act on the notice from the lawyer. If the hosting is pressured by the big company, they won’t hide you, they will try to save their asses and they will suspend your account and do what they tell them to do.

    Just don’t believe others that say that they will ignore DMCA notices, it’s just a marketing hype.

    The solution is simple. Don’s steal anything, do the things a legal way.
